What counts as a domain name dispute?
A domain name dispute arises when a domain name identical or similar to a trade mark or business name is registered or used in bad faith, i.e., to unfairly target the rights owner.
Can I stop someone using my company name in a domain?
Yes – if it was registered and/or used in bad faith, you can bring a complaint seeking transfer under Nominet’s DRS (for .uk) or the UDRP (for international domains like .com).
Do I need to own a trade mark to win a domain name dispute case?
No. Common-law rights in a business or trading name can also support a complaint. Even a distinctive personal name can suffice for .uk domains. But in each case you will still need to prove bad faith.
How much does a domain name complaint cost?
Nominet charges a fixed fee (currently £750 + VAT for a single expert or £200 + VAT in undefended cases). WIPO charges a US$1,500 filing fee. Legal fees depend on the complexity of the case and evidence required.
Can I recover damages as well as the domain name?
The DRS and UDRP can order transfer or cancellation only. To claim damages, you must bring separate court proceedings.
