DOMAIN NAME DISPUTE SOLICITORS

As specialist domain name dispute solicitors, Adlex Solicitors help clients recover or defend domain names under Nominet UK’s DRS and the international UDRP. Swift recovery steps can make the difference if your domain name is misused or hijacked, and smart defensive moves matter if someone unjustifiably claims your domain.

HOW WE CAN HELP WITH DOMAIN NAME DISPUTES

Recover a Domain Name

We act for businesses whose domain names have been registered and/or used in bad faith, helping them secure swift recovery and transfer. See our free initial opinion to check eligibility. See also our guide to recovering domains from former employees and developers for common pitfalls in reclaiming control of business domains.

Defend a Complaint

We represent domain owners accused of cybersquatting or bad-faith registration and prepare strong responses including legal letters and submissions under Nominet’s DRS and the UDRP. For practical strategies, see 10 tips for defending a domain dispute complaint

Nominet DRS Cases

Most UK disputes are handled through Nominet’s Dispute Resolution Service (DRS). We prepare, file and manage DRS complaints from start to decision. Learn more

UDRP Proceedings

For international domains (.com, .net etc.), we act in UDRP cases before WIPO and other providers. More about UDRP

Strategic Negotiation

We advise on settling domain name disputes before they escalate into formal proceedings, including by sending legal letters and buying or selling the domain name where appropriate.

COMMON QUESTIONS (Preview)

What counts as a domain name dispute?

A domain name dispute arises when a domain name identical or similar to a trade mark or business name is registered or used in bad faith, i.e., to unfairly target the rights owner.

Can I stop someone using my company name in a domain?

Yes – if it was registered and/or used in bad faith, you can bring a complaint seeking transfer under Nominet’s DRS (for .uk) or the UDRP (for international domains like .com).

Do I need to own a trade mark to win a domain name dispute case?

No. Common-law rights in a business or trading name can also support a complaint. Even a distinctive personal name can suffice for .uk domains. But in each case you will still need to prove bad faith.

How much does a domain name complaint cost?

Nominet charges a fixed fee (currently £750 + VAT for a single expert or £200 + VAT in undefended cases). WIPO charges a US$1,500 filing fee. Legal fees depend on the complexity of the case and evidence required.

Can I recover damages as well as the domain name?

The DRS and UDRP can order transfer or cancellation only. To claim damages, you must bring separate court proceedings.
